Govt will be responsible if DAP and building rules are amended for business groups : BIP

The existing flawed amendment process of Dhaka’s Detailed Area Plan (DAP) and building construction rules to meet the immoral demands of business interest groups must be stopped immediately.

Any amendment to Dhaka Detailed Area Plan (DAP) and building construction rules must be made by properly involving citizens, professionals, community and social organizations and subject to their opinions, keeping in mind the overall public welfare and livability of the city.

The government will have to take responsibility if DAP and building rules are amended in the interest of business groups, ignoring citizens. The interim government must take the initiative to properly investigate and publish a white paper on the changes that have been made in the plans of various areas of the country, including the Detailed Area Plan, in the interest of groups in the past. Government agencies including RAJUK, City Corporation, etc., should quickly prepare and implement area-based action plans for the implementation of the proposals made in the DAP for area-based civic amenities such as schools, hospitals, parks, playgrounds, etc. The interim government should take necessary measures to effectively investigate the business and group interests of the vested interests behind the unplanned development by demanding the cancellation of the DAP.

Appropriate legal action should be taken against the officials of the Ministry of Housing and Public Works, RAJUK, which is responsible for amending the Dhaka Detailed Area Plan (DAP) and building construction rules, who are working in the interests of the group. It is necessary to decide the philosophy of the plan by taking into account the socio-economic and planning issues, culture, community, etc. of the people of the country, and to prepare building-related laws, regulations and plans by involving the people in the kind of city they want. To ensure the balance and order of buildings in residential areas, the maximum height of buildings should be determined and suicidal thoughts like building a fire on the proposed road should be avoided.

To ensure the safety of people’s lives and reduce the damage caused by fire accidents, the construction of multi-storey buildings along narrow roads should be stopped and fire safety preventive measures should be ensured in buildings by bringing amendments to the building construction rules to consider buildings above six floors as multi-storey buildings.

It is not possible to make the city habitable and develop in a planned and sustainable way without eliminating the unethical influence of vested interests in planning and giving planners the opportunity to work independently. These views were highlighted at the ‘Press Conference’ titled ‘Changes in Dhaka’s Detailed Area Plan (DAP) and Building Construction Rules: Public Interest, Endangerment of Liveability and What Citizens Should Do’ held at the Abdus Salam Hall of the National Press Club, Dhaka today, March 18, 2025 (Tuesday), at 11 am.

The keynote address was delivered by Bangladesh Institute of Planners (BIP) President and Planning Professor Dr. Adil Muhammad Khan at the ‘News Conference’ moderated by BIP General Secretary Planner Sheikh Muhammad Mehdi Ahsan.

He said that although many important issues including the country’s constitution have been reformed after the July Uprising, there has been no rational reform of Bangladesh’s urbanization, urban planning and development, building, construction and environment-related laws and regulations for the sustainable and inclusive development of the entire country.

On the contrary, vested interests have always been spreading misinformation about DAP. The message that DAP will be amended soon has been widely disseminated, discouraging building owners interested in building construction. He commented that many professionals involved in building design and construction have tried to give a different message to building owners by not being interested in building designs as per the new DAP proposal.

The detailed regional plan of Dhaka has not been implemented properly due to repeated obstacles from vested interests. Immediately after the formulation of the last two detailed regional plans, the main strength of the DAP implementation has been destroyed by forming a review committee. In both cases, the government has given concessions to the overall public interest and the livability of the city to influential circles.

Similarly, the Land Development Rules for Private Residential Projects, 2004, were amended in 2015, in which the standards of civic amenities have been greatly reduced by ignoring public interest under pressure from real estate traders, resulting in a decrease in civic amenities such as parks, playgrounds, schools, etc. Such a conspiracy to endanger the environment and livability of the city is still going on.

He also said that in the 2008 Building Construction Rules, the minimum ‘FAR’ value for residential buildings was given as 3.15 and the maximum was 6.5, based on the width of the road and the size of the plot. In the current detailed zoning plan, this value was set at a maximum of 4.25 for the residential A3 (flat or apartment) category, which was followed in the draft building regulations in May 2024. However, in the draft building regulations prepared by RAJUK in December 2024, the FAR value for the plot-based residential A3 category has been increased to 5.5, which will severely increase the pressure on the almost uninhabitable city of Dhaka.

However, globally, the FAR value is usually between 1 and 2.5 for small-sized plot-based residential buildings. In DAP, many have proposed to increase the FAR and population density of the area several times. However, the civic amenities of those areas remain the same. Changing the FAR value of the regulations in the interest of the groupIt will pose a serious threat to the livability of the city.

According to the characteristics of urban planning, planning strategies, population density, far standards, height limits, etc. vary according to the type, quality and location of urban areas. In the draft building regulations prepared in early 2024, the far standards of residential areas were given separately for central Dhaka, outer cities and other urban areas, keeping in line with the detailed regional plan. It is very surprising that this area-based proposal has been omitted in the current building regulations proposal. The issue of proper setback distance of the building and the movement of natural light and air inside the building has also been neglected in the regulations proposal.

Professor Dr. Ahmed Kamruzzaman Majumder, Dean of the Faculty of Science and Chairman of the Center for Atmospheric Studies at Stamford University, said that Dhaka has become an inhuman city due to waterlogging, traffic congestion and waste mismanagement. Dhaka has now reached such a state that a recent survey has shown that Dhaka is ranked 143rd out of 147 livable cities in the world, which basically identifies Dhaka’s livability. International standards are not followed while implementing any project or establishment in Bangladesh. Also, due to lack of proper planning, the green areas and water bodies of Dhaka city have drastically reduced. He called on the government to stop the destruction of trees and forest land, including proper planning of the entire Dhaka city.

BIP General Secretary Planner Sheikh Muhammad Mehedi Ahsan said that for the sustainable planning of any city and to protect the overall public interest and public health, it is very necessary to formulate building construction rules with necessary regulations and their effective implementation. Dhaka’s building rules are being formulated to protect the interests of businessmen. The city’s doctor is a planner, but the RAJUK and the concerned ministry are completely ignoring the opinions of planners regarding the amendment of DAP. As a result, more disasters await the citizens of Dhaka.

Engineer Md. Abu Sadek, Executive Director of the Center for Housing and Building Research, said, “Even after so many years, gas, water and other services and civic amenities have not been developed in the Purbachal area to provide convenience to real estate traders. This is the first time since independence that the policy is being revised ignoring the opinions of professional organizations and ordinary citizens, which is completely immoral. Initiatives are being taken to make this change to increase the profits of a few vested interest business groups. He called on RAJUK and the concerned ministry to take the opinions of the concerned citizens and professional circles regarding the revision of DAP and build a planned city.

Professor of the Department of Architecture of BUET Dr. Shayer Gafur said that the city is getting out of the hands of the citizens. The city has become a commodity for businessmen. Businessmen are increasing the height and width of the building to save their interests politically. As a result, the environment is being destroyed. Building new shopping malls on the side of the main road without any kind of plan is creating severe traffic congestion. Therefore, it should be noted that everything should not be centralized in one city. If proper planning and decentralization strategies are adopted, it is possible to reduce the population of Dhaka.

Former BIP Vice President Fazle Reza Sumon said that the DAP and building rules should be amended based on the opinions of all stakeholders involved. The rules cannot be amended for the benefit of a special group. He further said that those who were at the forefront of protecting the environment in the past are now plotting to destroy the livability of Dhaka by amending the DAP and rules, which is not desirable. He appealed to the advisors not to amend any law or plan to destroy the livability of Dhaka.

Mizanur Rahman, a civil rights activist from Jurain area, said that there is no place for children to play in Dhaka city, and the surrounding environment is not good. As a result, children are confined to their homes. Their normal development is being hindered. Work for Better Bangladesh (WBB) TAST Director Gaus Peary said, “We have to think about how to keep the city livable for people. Those who do not have patriotism do not want the country to be livable. We do not want any plan that destroys livability, life and nature.” Syeda Ratna, coordinator of the Tentultala Field Protection Movement, said, “The discrimination for which the July Movement was held is still going on, which is visible in Panthakunja Park. Dhaka’s fields will be open, no field can be closed for business purposes.”

Selina Akhter, president of Ward No. 19 Community Development Organization, Karail, said that the current government is part of the anti-discrimination movement. However, in the planning meeting of the Advisory Council to be held on March 19, there is no plan to protect the basic rights of about 2.5 lakh low-income people living in Karail, including housing. He also mentioned that in countries like India, Sri Lanka and Thailand, there are government housing and grant schemes for low-income people. Although several NGOs are working in Bangladesh, there is no significant initiative from the government. He also highlighted the insufficiency of potable water in Karail slums and the illegal business of traders with water from two pumps and demanded a remedy for this. He called for ensuring the basic rights of all by including low-income people in the country’s development plan.
